A 2012 Senate Homeland Security and Governmental Affairs Committee report, “Social Security Disability Programs: Improving the Quality of Benefit Award Decisions,” claims that 25{163d132be0c33ef527548f598c16a5854f0363fa1b320787bb9017ebc72327da} of all disability insurance claim decisions were flawed, improperly addressing “insufficient, contradictory, and incomplete evidence, thus increasing the chances of rewarding nondisabled persons.” As a result, numerous Americans have been cut off. This happened most recently in May when over one thousand West Virginia and Kentucky residents received letters informing them that their disability checks will soon stop due to alleged disability fraud.
What to Do if You Receive a Letter from the Social Security Administration Cutting Off Your Disability Benefits
All claims for Social Security Disability Insurance benefits are reviewed at different times after you are approved. If the Social Security Administration (SSA) determines that you no longer qualify for disability benefits, they will send you a letter, similar to the ones mentioned above, terminating those benefits. If this happens to you and you feel the decision is unfounded, it is important to seek immediate legal representation to appeal the decision. As long as your appeal is received within 10 days of your termination letter, you can elect to continue receiving your benefits while they process your appeal. If you do not file an appeal within those first 10 days, you still have time – sixty days from the receipt of the termination letter to be exact. However, if you miss that initial 10 day period, the SSA will suspend your benefits until a judge decides on your appeal.
